Our terms and conditions are binding with the sending of your order.
1. General / Validity (no private sale)
Our terms of delivery and payment apply exclusively to all deliveries and services, even if no reference is made to them in individual cases. External conditions are hereby expressly rejected. Our conditions are deemed to be recognized at the latest when the order is sent. Deviations are only valid in writing. Subject to prior sale. With the issue of these general terms of delivery and payment, all previous ones become invalid. Changes and additions to these conditions and prices are expressly reserved.
2. Offer
All offers from www.Sensor-Tec.de on the website www.Sensor-Tec.de are non-binding and subject to change. Small deviations and technical changes compared to our images or descriptions are possible. The contract is concluded when the order process is completed on the www.Sensor-Tec.de website and the order is confirmed by www.Sensor-Tec.de by email or the order is carried out by www.Sensor-Tec.de.
3. Prices and terms of payment
The prices shown on the www.Sensor-Tec.de website apply at the time of the order. Each order is the subject of a separate contract. The prices in euros are exclusive of statutory VAT, plus material surcharges, if applicable. We are entitled to request an advance payment for custom-made products. We reserve the right to accept checks or bills of exchange in any case. Acceptances are only made on account of payment, but not in lieu of performance. Exchange costs including exchange taxes, discount charges and the like are borne by the buyer. In the event of default in payment, the seller is entitled to charge interest at a rate of 5 percentage points above the respective base rate of the Deutsche Bundesbank. The buyer defaults in payment as soon as the payment term specified in the invoice is exceeded. A separate written reminder is not required.
Any additional costs arising from the payment method (e.g. cash on delivery fee) will also be charged separately. The withholding of payments or offsetting against counterclaims by the buyer is only permitted if these claims are undisputed or legally established by the seller. If the invoice settlement is delayed - even for just one invoice - all claims of the seller are due immediately. This also applies if the seller becomes aware of the reduced creditworthiness of the buyer, regardless of the term of any bills of exchange accepted for payment.
4. Delivery, delivery times and shipping costs
The delivery of the goods to the customer takes place through the delivery services specified during the ordering process. The customer will be informed of the shipping costs before the ordering process is initiated within the shopping cart. Delivery times are only approximately agreed. This does not apply to deadlines that have been made binding in writing. Partial deliveries are considered to be a special transaction and have no effect on the unfulfilled part of an order. Unforeseen delivery obstacles, such as force majeure, strikes, operational disruptions in our own company and in that of the upstream supplier, transport difficulties, delivery delays by upstream suppliers, entitle the customer to postpone delivery for a further reasonable time or to withdraw from the contract, if it has not yet been fulfilled. Packaging Shipping and packaging costs as well as transport insurance are borne by the buyer. The goods are packaged in the usual way. The buyer bears the transport risk. Purchased items can only be returned with prior agreement in individual cases. A right of exchange and right of return is excluded for traders.
If www.Sensor-Tec.de incurs additional costs due to insufficient franking of the return, these costs will be offset against any payments made by the customer. www.Sensor-Tec.de expressly reserves the right to claim compensation for damaged goods. If the customer is responsible for deterioration, destruction or any other impossibility, he has to compensate for the decrease in value; Sections 351 and 353 BGB do not apply. The goods must be returned in the original packaging. The customer is liable for any damage to the goods that can be traced back to inadequate packaging.
5. The buyer meets the obligation according to Section 377 of the German Commercial Code The buyer has to examine the goods immediately after delivery by the seller and, if a defect becomes apparent, to notify the seller immediately. If the buyer fails to notify us, the goods are deemed to have been approved, unless there is a defect that could not be identified during the examination. If such a defect appears later, the report must be made immediately after it is discovered; otherwise the goods shall be deemed approved even with regard to this defect. 6. Warranty A guarantee of freedom from defects is provided for a maximum of one year from the transfer of risk. The general rules of the BGB apply. The warranty period is not renewed or extended by any subsequent improvement or replacement deliveries. No guarantee is given for spare parts that are delivered after the warranty period has expired and not invoiced. If a complaint is justified, we guarantee that we will either repair or replace the defective goods with new ones, at our option. If two attempts at improvement or replacement delivery fail, the buyer can choose to withdraw from the purchase contract or reduce the purchase price. Further claims of the buyer from defects in the item, including claims due to the lack of warranted properties, claims for compensation for such damage that did not occur on the delivery item itself (consequential damage), as well as claims from positive breach of contract are excluded in accordance with the following section 8.

7. Liability
All claims of the buyer for compensation for direct or indirect damage - including accompanying and consequential damage - against us, our employees and other vicarious agents - regardless of the legal basis - are excluded, unless the damage is due to intent or gross negligence sweetness. In the event that the order is a research and development order (R&D order), liability for defects or consequential damage is fundamentally excluded.
8. Limitation period
All claims of the buyer against us - regardless of the legal basis - expire no later than 6 months after delivery or after the claim arises, whichever is earlier. Warranty claims for defects that were not already present upon delivery become statute-barred upon expiry of the warranty period specified in Section 7.
9. Data protection
We store and process the personal data of our business partners that are related to business transactions, insofar as this is necessary for the proper processing of the contractual relationships.
10. Severability Clause
Should a provision of the contract be or become ineffective or should the contract be incomplete, the remaining content of the contract will not be affected. The ineffective provision shall be replaced by a provision that comes closest to the meaning and purpose of the ineffective provision in a legally effective manner. The same applies to any gaps in the contract, place of performance, place of jurisdiction.
The place of performance for deliveries and return deliveries as well as payments is Netphen. Siegen has been agreed as the place of jurisdiction, also for bills of exchange and check actions.
Devices that have to be disposed of must be returned to Sensor-Tec for disposal.
As of 01.2021
